RESEARCH / VERSION 1.1 / 16 OCTOBER 2026

Drug-use allegations and a separate established disability

The tribunal distinguished a contention that drug use exacerbated existing disabilities from a contention that the impairment relied upon was addiction. It found that the established disabilities predated drug use and that the employer knew or ought reasonably to have known of them. Some discrimination and harassment complaints succeeded and others failed.
